ADA TOWNSHIP, Mich. (WOOD) — Amway is suing a Florida company for allegedly selling its trademarked products on Amazon.
The lawsuit, filed Sept. 2 in U.S. District Court, accuses Bregener Store and its apparent operator of trademark infringement for the “unlawful sale on the Internet of materially different and non-genuine products bearing Plaintiffs’ trademarks.” Amway says Bregener Store has sold “high volumes” of these products on Amazon.
Amway sells its products to American consumers only on its website or through official distributors — a step the Ada Township-based company says “ensure(s) the safety, well being, and satisfaction of consumers and maintain(s) the integrity and reputation of the Amway family of brands.”
But the brand owner cannot control the quality of products sold by unauthorized sellers, the lawsuit argues. That can pose health and safety risks, Amway contends, “particularly when, as here, some of a brand owner’s products are ingested by consumers.” The company adds that consumers may mistakenly believe they are purchasing from the brand owner or an authorized seller.
“Through their unauthorized use of the Amway Trademarks, Defendants have misled — and continue to mislead — consumers into believing they are purchasing products with the same quality controls as genuine Amway products,” the suit says. “In reality, however, the products sold by Defendants are materially different from genuine Amway products because they are not subject to, do not abide by, and interfere with Plaintiffs’ quality control and customer service requirements.”
Amway says such unauthorized sales can cause serious harm to the brand.
“When a customer purchases a product on a marketplace and receives a product that
is damaged, defective, expired, soon-to-expire, or of otherwise poor quality, the customer is much more likely to associate that frustration with the brand/manufacturer than the product seller,” the lawsuit says.
It claims that Amway products listed by unauthorized Amazon sellers have received negative reviews, in which people complained that the products were “not as ordered, tampered with, nearly expired, delivered without critical safety components, such as safety seals, or of otherwise poor quality.”
Amway says it sent Bregener Store a cease-and-desist letter in 2025 after discovering what was happening. However, that letter and other subsequent letters were ignored and Bregener Store has continued to sell the offending products, according to the lawsuit.
Amway asked the court for a judgment in its favor and a range of relief, including a permanent injunction that would stop Bregener Store from selling the products at issue.
Amway saw $7.3 billion in global sales in 2025, which was a drop from the year prior.
