HELENA, Mont. —As AI continues to be a big topic nationwide, Montana’s Attorney General Austin Knudsen’s lawsuit claiming OpenAI is dangerous to children is still in the early phases.
Knudsen filed the case in Lewis and Clark County, and it is now moving through state court.
“They haven’t even responded yet. They’ve got 90 days to respond,” Knudsen said. “We’ll then get into the discovery phases where we will request documentation and whatever paperwork that might be out there, communications that might be out there.”
The lawsuit claims OpenAI’s chatbot ChatGPT endangers children and teens by providing harmful advice and failing to adequately protect young users.
“This thing is dangerous. I mean, there are documented cases where ChatGPT is telling kids how to commit suicide, telling them how to mix dangerous cocktails of illegal drugs. This is an algorithm that wants gratification and wants positive reinforcement from its users. And oftentimes that leads to dangerous results. We’ve certainly seen that,” Knudsen said.
OpenAI says fictional sexual roleplay scenarios involving children and attempting to generate stories where minors are put in sexually inappropriate and/or abusive situations is a violation of child safety policies.
The company says “we take swift action to detect these attempts and ban the associated accounts. Our systems are designed to detect and block these attempts, and accounts engaging in this behavior are banned and reported to the National Center for Missing & Exploited Children when apparent CSAM is involved.
As the case develops, Knudsen says change must happen.
“I want change behavior from the company. They’re not asking for consent age. They’re not asking parents for consent. They’re not asking for age verification of young people who may be using this thing and getting some really dangerous advice. This thing is not ready for primetime,” Knudsen said.
The Attorney General’s Office says they’re hoping for a response from OpenAI in the coming weeks.
