A new class action lawsuit accuses luxury home goods company Lenox of sending spam emails with false or misleading subject lines.
Plaintiff Matthew Wildman’s class action lawsuit claims Lenox sent him and other consumers spam emails with subject lines that falsely created a sense of urgency to encourage them to open the emails and purchase the company’s products.
Lenox’s spam emails “waste consumers’ time by enticing them to engage with the defendant’s marketing efforts for fear of missing out,” Wildman argues in the Lenox class action.
Wildman wants to represent a class of Washington residents who, during the class period, received a commercial email from Lenox that contained subject-line messaging that misrepresented the facts of a sale, deal or promotion.
Wildman claims Lenox is guilty of violating the Commercial Electronic Mail Act and the Consumer Protection Act.
Spam email lawsuit claims Lenox repeatedly extended sale deadlines
Wildman argues the subject lines of the spam emails Lenox sent to consumers falsely claimed the time to act was limited, such as with the subject line “LAST CALL 30% OFF.”
“Lenox regularly titles its emails with urgent subject headings that do not reflect the true availability of the advertised deal,” the Lenox class action lawsuit says. Wildman claims Lenox would routinely send follow-up emails with subject lines that falsely extended the same promotions it had represented as ending the day before.
The plaintiff argues Lenox’s spam emails were part of a calculated marketing strategy designed to maximize sales by distorting factual information about the duration and availability of its promotions.
Wildman claims the spam emails Lenox sent to consumers were a violation of his rights under the Commercial Electronic Mail Act to be free from deceptive commercial emails.
Wildman demands a jury trial and requests declaratory and injunctive relief and an award of actual or liquidated damages, trebled, for himself and all class members.
In other alleged unlawful practices, Basset and other furniture retailers are facing accusations of near-perpetual discounts and inflated, self-created strikethrough reference prices.
