MUMBAI: The Food Safety and Standards Authority of India (FSSAI) has initiated penal action against five major e-commerce platforms over alleged food safety and regulatory non-compliances, including misleading product claims and the sale or display of prohibited food articles.
The action covers Amazon Seller Services, Flipkart India, Swiggy Instamart, Zepto Marketplace and Innovative Retail Concepts, which operates BigBasket.
According to FSSAI, the enforcement action has been initiated under the Food Safety and Standards Act, 2006, and applicable FSSAI regulations.
FSSAI has initiated penal action against Amazon Seller Services Pvt Ltd over the listing of Happilo Premium Date Bites – Zesty Orange, citing misleading or non-compliant claims.
The regulator has also flagged the sale, display and offer for sale of Datura (Dhatura) fruits and seeds on the platform, citing non-compliance with applicable provisions of the FSS Act, 2006 governing food sold through e-commerce platforms.
Flipkart India Pvt Ltd has similarly faced penal action over the listing of Happilo Premium Date Bites – Zesty Orange, with FSSAI citing misleading or non-compliant claims.
Swiggy Instamart has been cited over the Happilo product as well as product information and claims associated with three Milky Mist products: Fresh Low Fat Cream, Farm Fresh Curd and Greek Yoghurt.
FSSAI said the action relates to misleading claims and non-compliant product information.
The quick-commerce platform has also been flagged over the sale, display and offer for sale of Datura fruits and seeds.
Zepto Marketplace Pvt Ltd has faced penal action over the listing of Happilo Premium Date Bites – Zesty Orange, with FSSAI citing misleading or non-compliant claims.
Innovative Retail Concepts Pvt Ltd, which operates BigBasket, has been cited over the same Happilo product.
BigBasket has also been flagged over the Milky Mist Fresh Low Fat Cream, Farm Fresh Curd and Greek Yoghurt products for misleading claims and non-compliant product information.
FSSAI has additionally initiated action over the sale, display and offer for sale of Datura fruits and seeds on the platform.
The regulator’s action highlights the responsibility of e-commerce and quick-commerce platforms to ensure that food products listed and sold through their services comply with food safety requirements, product information rules and restrictions applicable under Indian food law.
The enforcement proceedings have been initiated under the FSS Act, 2006, and relevant FSSAI regulations.
