OneTouchPoint Data Breach Class Action Settlement
Individuals who received notice of the OneTouchPoint data breach may be eligible to claim up to $5,600 from a class action settlement.
People who received a notice stating the April 2022 data breach involving OneTouchPoint Corp. may have impacted their private information could be eligible to claim up to $5,600 from a class action settlement.
OneTouchPoint Corp. agreed to settle a class action lawsuit alleging it failed to adequately protect the private information of current and former patients, clients and employees.
Who can file a claim for a data breach payout?
There are two groups of class members:
- Monetary settlement class: Individuals in the United States whose private information OTP’s investigation determined the April 2022 data breach impacted
- Injunctive relief settlement class: Individuals in the United States and its territories who received a notice from OTP regarding the breach’s potential impact on their private information but whom the investigation could not determine an actual impact
Monetary class members are eligible to submit a claim. Injunctive relief class members are not eligible to submit a claim but will reportedly benefit from OTP’s cybersecurity enhancements for at least five years.
How much are settlement payments?
Monetary settlement class members have the following benefit options:
- Compensation for ordinary losses: Class members can claim up to $500 for unreimbursed out-of-pocket expenses related to the data breach. This includes costs such as bank fees, postage for contacting financial institutions and fees for credit reports, credit monitoring or identity theft insurance.
- Compensation for extraordinary losses: Class members can claim up to $5,000 for documented monetary losses that occurred between April 28, 2022, and Nov. 16, 2026, that the data breach most likely caused and that other compensation does not already cover. This includes professional attorneys’ or accountants’ fees and fees for credit repair services.
- Compensation for time spent: Class members can claim up to four hours of lost time at $25 per hour for time spent responding to the data breach ($100 maximum).
- Alternative cash payment: Class members who do not submit an ordinary losses, extraordinary losses or lost-time claim can submit a claim to receive a one-time $75 payment.
- Credit monitoring: All class members can elect to receive two years of one-bureau credit monitoring with at least $1 million in fraud protection.
How to claim a class action rebate
To receive a settlement payment, monetary settlement class members can file a claim online or print and complete the PDF claim form and mail it to the settlement administrator.

Required proof and claim information
- Online claims require the claim number and PIN from the settlement notice the class member received.
- Ordinary losses claims require supporting documentation, which may include receipts, bank or credit card statements or other proof of expenses.
- Extraordinary losses claims require supporting documentation, which includes proof of identity theft or fraud traceable to the data breach, bank or credit card statements showing losses and receipts for services.
- Time-spent claims required a description of how the class member spent their time responding to the data breach.

Settlement fund breakdown

- Payments to approved claimants: Total determined by number of valid claims filed
- Injunctive relief: Security enhancements valued at approximately $2,000,000

When is the OneTouchPoint data breach payout date?
The settlement administrator will issue payments to approved claimants after it completes claim processing or within 60 days of the final approval date, whichever is later.
Why did this class action settlement happen?
The class action lawsuit alleged a cybersecurity incident in April 2022 led to the potential compromise of private information OneTouchPoint Corp. maintained. The plaintiffs claimed OTP failed to adequately protect this information.
OTP denies any wrongdoing but agreed to settle to avoid the cost and uncertainty of further litigation.
