With Uber over the last 15 years, there’s been an explosion of the use of that service and it’s a great service. The problem is, is that people driving automobiles, whether they’re driving their personal car, driving for Uber or Lyft, they get in accidents, too. And so what we’ve seen as passengers in an Uber car, which is involved in an accident. If it’s the Uber driver’s fault, the claim is against the Uber driver for his negligence because as a passenger, you’re completely without fault. You did nothing in the operation of either motor vehicle which caused the accident. So if it’s the Uber driver who’s at fault for the accident, your claim would be against him and his insurance carrier. If you’re riding in an Uber in the other vehicle, acted in a negligent way or was negligent causing the accident, you would bring your claim against the driver and his insurance company of that car.
